2. Diagnostic of the Post C-23 Environment and Implications

Presentation

The parliamentary environment has become increasingly adversarial and more partisan, which risks having ramifications on institutions such as agents of Parliament.

The debate on Bill C-23 showed a lack of consensus on electoral operations among parliamentarians. Traditionally, changes to the Canada Elections Act are based on some form of consensus.

The increased complexity of those rules will likely also affect other players – including voters, who may face delays at the polls. Elections Canada could also experience difficulty in recruiting election workers, as the changes brought about by Bill C-23 significantly increase the accountability of those workers, most of whom are hired for one day to carry out complicated tasks.

Elections Canada needs to decide how to position itself in this environment to ensure that it moves forward in a constructive and effective manner. The agency also needs to demonstrate that it is working to align itself with the expectations underlying the amended Canada Elections Act and will continue to conduct fair, accessible and orderly elections.

Discussion

Despite the complexity of the issues involved, members noticed a high level of interest from the media and the general population on Bill C-23. This level of debate, they pointed out, is unprecedented and evidence of a democratic life among Canadians.

Members applauded the professionalism of the CEO throughout the debates on Bill C-23 and expressed trust that the agency will remain professional in implementing the changes to the Canada Elections Act and preparing for the 42nd general election.

Members encouraged the CEO to build bridges with stakeholders, including NGOs, to discuss some of the decisions he will make moving forward. Members also agreed that the CEO should engage Parliament and, to the extent that they are known in advance, outline the implications of the new provisions of the Act in order to avoid any surprises at election time.

With respect to young electors, members expressed concern that the debate over Bill C-23 and the increasingly partisan environment may have a negative effect on their desire to participate in the electoral process.
