Adaptation by instruction
Pursuant to section 179 of the special voting rules as adapted for the purposes of a by-election

Proof of residence when the address on the
piece or pieces of identification provided with an
application for registration and special ballot does not
prove residence but is consistent with information in
the register or on a list of electors

Whereas Division 4 of the Special Voting Rules as Adapted for the Purposes of a By-election permits electors residing in Canada who wish to vote by special ballot to apply for registration and special ballot and to vote by special ballot;

Whereas paragraph 233(1)(c) of the Special Voting Rules as Adapted for the Purposes of a By-election requires that such an elector submit "satisfactory proof of the elector's identity and residence" with the application for registration and special ballot;

Whereas some electors residing in rural or remote areas have no civic address by which to prove their residence, or such a residential address is not contained in their piece or pieces of identification;

Whereas by enacting Chapter 37 of the Statutes of Canada, 2007, Parliament amended the new rules on elector identification at ordinary and advance polling stations by adding a new subsection 143(3.1) to the Canada Elections Act, providing that, if the address contained in the piece or pieces of identification provided did not prove the elector's residence but was consistent with information related to the elector appearing on the list of electors, the elector's residence was deemed to have been proven;

and Whereas it is necessary to provide the same flexibility for an elector residing in Canada who votes by special ballot, when the address on the elector's piece of identification is consistent with information related to the elector that appears in the National Register of Electors in the case of applications received by the special voting rules administrator, or on the list of electors in the case of applications received by the returning officer;

Therefore, pursuant to section 179 of the Special Voting Rules as Adapted for the Purposes of a By-election, the Chief Electoral Officer adapts section 233 of these Rules by adding the following immediately after subsection 233(1.1):
