March 8, 2008 – Advance Polling

in the
ELECTORAL DISTRICTS OF TORONTO CENTRE AND WILLOWDALE

ADAPTATION OF SECTION 171 OF THE CANADA ELECTIONS ACT
PURSUANT TO SECTION 17 OF THAT ACT

WHEREAS by-elections were called on December 21, 2007 in the electoral districts of Toronto Centre and Willowdale;

WHEREAS in accordance with the Canada Elections Act, advance polling days for the electoral districts of Toronto Centre and Willowdale are on Friday, March 7, 2008, Saturday, March 8, 2008, and Monday, March 10, 2008;

WHEREAS the Act provides for advance polls to be open between the hours of noon and 8:00 p.m. on advance polling days;

WHEREAS Environment Canada has issued an advisory warning for Saturday, March 8, 2008 to the effect that dangerous winter weather conditions are imminent or occurring in the electoral districts of Toronto Centre and Willowdale;

AND WHEREAS subsection 17(1) of the Act provides that "During an election period or within 30 days after it, if an emergency, an unusual or unforeseen circumstance or an error makes it necessary, the Chief Electoral Officer may adapt any provision of this Act and, in particular, may extend the time for doing any act, subject to subsection (2), or may increase the number of election officers or polling stations.";

THEREFORE, pursuant to subsection 17(1) of the Act, the Chief Electoral Officer hereby adapts the Canada Elections Act as follows:

Section 171 is adapted by the addition of the following:

(3) Notwithstanding subsection (2), a returning officer may, with the prior approval of the Chief Electoral Officer, reduce the number of hours during which an advance poll is open or cancel the advance poll.
