Adaptation to allow for mobile advance polls in the electoral district of Abitibi–Baie James–Nunavik–Eeyou

ADAPTATION OF SECTION 171 OF THE CANADA ELECTIONS ACT TO ALLOW FOR
MOBILE ADVANCE POLLS
IN THE ELECTORAL DISTRICT OF
ABITIBI–BAIE JAMES—NUNAVIK–EEYOU
PURSUANT TO SUBSECTION 17(1) OF THAT ACT

Whereas the 41st federal general election was called on March 26, 2011 with polling day on May 2, 2011;

whereas section 168 provides that the returning officer is required to establish in his or her electoral district advance polling districts that consist of one or more polling divisions, and that an advance polling station is established in each advance polling district;

whereas subsection 171(2) provides that an advance poll shall only be open between the hours of noon and 8:00 p.m. on Friday, Saturday and Monday, the 10th, 9th and 7th days, respectively, before polling day;

whereas section 172 provides that the returning officer shall give a notice in the prescribed form that sets out, among other things, information about the location of each advance polling station, and that no later than Saturday, the 16th day before polling day, the returning officer shall send two copies of the notice to each candidate and to the Chief Electoral Officer;

whereas the returning officer in the electoral district of Abitibi—Baie James—Nunavik—Eeyou was unable to establish advance polling stations in a number of communities before the 16th day before polling day;

whereas the communities in question are unusually isolated from neighbouring communities in which advance polls have been established, making travel to those neighbouring communities for the purpose of voting difficult or impossible and have requested that greater efforts be made to establish advance polling stations in their communities;

whereas the returning officer is unable to recruit sufficient election workers to staff advance polls in all of the communities in question, but is able to provide advance polling opportunities to all electors through the use of mobile advance polls open in each of the communities in question for a portion of the period specified in section 171(2);

and whereas subsection 17(1) of the Canada Elections Act provides that:

17. (1) During an election period or within 30 days after it, if an emergency, an unusual or unforeseen circumstance or an error makes it necessary, the Chief Electoral Officer may adapt any provision of this Act and, in particular, may extend the time for doing any act, subject to subsection (2), or may increase the number of election officers or polling stations.

Therefore, the Canada Elections Act is hereby adapted by adding the following provisions:

171.1 (1) Despite subsection 171(2), the returning officer in the electoral district of Abitibi—Baie James—Nunavik—Eeyou may, in accordance with the instructions of the Chief Electoral Officer, establish mobile advance polling stations to be located in two or more communities consecutively over the course of the advance polling times set out in subsection 171(2).

(2) The returning officer shall send without delay to those who received from him the notice mentioned at section 172 an amended notice including any new information respecting advance polling stations established pursuant to the preceding subsection.
