March 19, 2008 – Advance Polling

ELECTORAL DISTRICT OF
DESNETHÉ–MISSINIPPI–CHURCHILL RIVER

ADAPTATION OF THE CANADA ELECTIONS ACT
PURSUANT TO SECTION 17 OF THAT ACT

WHEREAS a by-election was called on December 21, 2007, in the electoral district of Desnethé–Missinippi–Churchill River, with polling day on March 17, 2008;

AND WHEREAS advance polling was held on Friday, March 7, Saturday, March 8 and Monday, March 10, 2008 and a number of electors voted during the three days at advance poll number 603;

AND WHEREAS voting took place on March 17, 2008 at regular poll number 19;

AND WHEREAS the ballots from advance poll number 603 were combined by error with those of regular poll number 19 at the time of counting the votes and this error has made it impossible to count and report the votes for advance poll number 603 and regular poll number 19 separately as provided for in the Canada Elections Act;

AND WHEREAS subsection 17(1) of the Act provides that "During an election period or within 30 days after it, if an emergency, an unusual or unforeseen circumstance or an error makes it necessary, the Chief Electoral Officer may adapt any provision of this Act and, in particular, may extend the time for doing any act, subject to subsection (2), or may increase the number of election officers or polling stations";

AND WHEREAS it is desirable to adapt the Act to permit the reporting of the results of advance poll number 603 and regular poll number 19 under regular poll number 19;

THEREFORE the votes cast at advance poll number 603 are deemed to have been cast at regular poll number 19 and the counting and reporting procedures under sections 283 to 298 of the Canada Elections Act are adapted accordingly.
