Introduction

ANNUAL FISCAL RETURNS

This database contains all the information produced by the registered political parties on their financial operations.

Pursuant to subsection 424(1) of the Canada Elections Act, the chief agent of a registered party is required to provide the Chief Electoral Officer with a return on the party's financial transactions, other than those related to a general election, within six months after the end of the fiscal year. The Political Party Financial Transactions Return must be accompanied by an auditor's report on the return and a declaration by the chief agent concerning the financial transactions.

Political Party Financial Transactions Return

The Political Party Financial Transactions Return must include:

  • a statement of contributions received by the registered party and the number of contributors;
  • the name and address of each contributor who made contributions of a total of more than $200 to the party, that total amount as well as the amount of each such contribution and the date on which it was received by the party;
  • the name and address of each contributor who made contributions to the party that includes a directed contribution to a leadership contestant, the amount of the contribution, the amount of the directed contribution and the date of the receipt of the contribution;
  • a statement of assets and liabilities and any surplus or deficit in accordance with generally accepted accounting principles, including disputed and unpaid claims;
  • a statement of revenues and expenses in accordance with generally accepted accounting principles;
  • a statement, by electoral district, of goods or services provided or funds transferred to a candidate or the electoral district association;
  • a statement of each amount transferred to a leadership contestant out of a directed contribution;
  • a statement of goods or services provided or funds transferred to the party from any of its registered associations, a candidate, a leadership contestant or a nomination contestant;
  • a statement of election expenses incurred and non-monetary contributions used by the party for each by-election during the fiscal period;
  • a statement of loans or security including any conditions on them;
  • a statement of contributions received by the party, but returned in whole or in part to the contributors or otherwise dealt with in accordance with the Act.

QUARTERLY RETURNS

Pursuant to subsection 424.1(1) of the Canada Elections Act, the chief agent of a registered party that is entitled to a quarterly allowance shall, for each quarter of the fiscal period of the party, provide the Chief Electoral Officer with a quarterly return on the party's contributions and transfers, within 30 days after the end of the period to which it relates.

The contributions and transfers for the entire year will be reported in the Political Party Financial Transactions Return, submitted six months following the end of the fiscal year. This fiscal return must be accompanied by an auditor's report on the return and a declaration by the chief agent concerning the report.

Registered Party Financial Transactions Quarterly Return

The Registered Party Financial Transactions Quarterly Return must include:

  • the total contributions received by the registered party and the number of contributors;
  • the name and address of each contributor who made contributions of a total amount of more than $200 to the registered party, that total amount, as well as the amount of each such contribution and the date on which it was received by the party;
  • the name and address of each contributor who has made a contribution to the party that includes a directed contribution, the amount of the contribution, the amount of the directed contribution and the date of the receipt of the contribution;
  • a statement of the commercial value of goods or services provided and of funds transferred to the registered party from any of its registered associations, a candidate, a leadership contestant or a nomination contestant;
  • a statement of contributions received by the registered party but returned in whole or in part to the contributors or otherwise dealt with in accordance with the Act.

ELECTION EXPENSES RETURNS

Pursuant to subsection 429(1) of the Canada Elections Act, the chief agent of a registered party is required to provide the Chief Electoral Officer with a return on the party's financial transactions related to a general election, within six months after the polling day for the general election. The Registered Party Return in Respect of General Election Expenses must be accompanied by an auditor's report on the return and a declaration by the chief agent concerning the financial transactions.

The Registered Party Return in Respect of General Election Expenses must include:

  • a statement of general election expenses incurred and non-monetary contributions used by the party for a general election.

You will find below information about the Registered Party Financial Transactions Return and the instructions given to chief agents of registered parties for filling it out.

Introduction

As the chief agent of a registered political party, you must submit the Registered Party Financial Transactions Return (EC 20239) to the Chief Electoral Officer within six months of the end of the fiscal period. This introduction to the form provides a brief description of the contents of the four parts of the form. It is followed by detailed instructions for filling out the return. A copy of your party’s financial statements prepared in accordance with generally accepted accounting principles, and the auditor’s report, must accompany the return.

The parts of form EC 20239

Part 1. Declaration

Includes information on the party and the chief agent. It contains the sworn statement of the chief agent about the completeness and accuracy of the return.

Part 2. Cash inflows

Part 2a. Statement of contributions received - Details of contributions from individuals

Lists all contributions received from individuals, including the date received, the name, address and amount of all monetary and non-monetary contributions and the total amount per contributor for all contributors who have given over $200 in the year, the amount and number of all monetary and non-monetary contributions of $200 or less, and the amount and approximate number of anonymous monetary and non-monetary contributions of $20 or less.

Part 2b. Statement of directed contributions received for transfer to a leadership contestant

Lists contributions received by the registered party directed to a leadership contestant, including the date the contribution was received by the party, the full name and address of the contributor, the total amount of the contribution, the directed amount, the amount transferred to the leadership contestant and the date of the transfer.

Part 2c. Statement of contributions received - Details of operating loans

Lists the date the loan was received, the name and address of the lender, the name of the loan’s guarantor, the contributor class of the lender, and the principal for each loan taken by the party. The maximum amount drawn against an overdraft or line of credit along with the name and address of the financial institution and the interest rate charged are also disclosed. A list of any conditions on the loan must be attached.

Part 2d. Statement of contributions received - Contributions returned to donors or otherwise dealt with in accordance with the Act

Lists the date the contribution was received, the name and address of the contributor, the class of contributor, the amount or commercial value of any contribution that was returned to the donor or remitted to the Chief Electoral Officer, and the date that the contribution was returned or remitted.

Part 2e. Statement of transfers received

Lists the date the transfer was received, the name of the transferor, and the monetary or non-monetary amount transferred from the registered association, a candidate, a leadership contestant or a nomination contestant.

Part 2f. Summary of contributions, loans and transfers

Summarizes the information reported in parts 2a, 2c and 2e, including the total amount and number of monetary contributions and non-monetary contributions, the total principal of loans and the total amount of the transfers received.

Part 3a. Statement of election expenses for a by-election

For each electoral district, lists all election expenses by date, the amount paid, the amount unpaid, the non-monetary contribution received, a classification of the expense by kind and its commercial value.

Part 3b. Statement of transfers to a candidate, an electoral district association, a leadership contestant or a nomination contestant

Provides details on monetary or non-monetary transfers made from the registered party to a candidate or an electoral district association and the details of the goods or services provided to leadership contestants or nomination contestants.

Part 3c. Statement of unpaid claims

This part provides details on all unpaid claims, including the name and address of the supplier, the class of contributor to which the supplier belongs, and the agreed or disputed amount of the claim.

Sets out the requirements for documents to be included with the return: the statement of assets and liabilities and surplus or deficit, the statement of revenues and expenses, and the auditor’s report.

Filling out the Registered Party Financial Transactions Return

Part 1. Declaration

In this part of the return, you as the chief agent report administrative information about the return, and sign the declaration about its completeness and accuracy.

Section A. Party’s information

Enter the full name, address, telephone number and e-mail address of the party.

Section B. Chief agent’s information

Enter your full name, address, telephone number and e-mail address.

Section C. Declaration

Read, sign and put the date in the space indicated.

Part 2a. Statement of contributions received

You must give the full name and address of each contributor who has donated a total amount of funds and goods or services greater than $200.

Elections Canada recommends that you inform your contributors of the requirement for the Chief Electoral Officer to publish the names and addresses of contributors who give more than $200, under section 412 of the Canada Elections Act.

  1. Determine the total monetary and non-monetary amount contributed by each individual campaign contributor.
  2. For multiple contributions from the same contributor that total an amount greater than $200, for each contribution enter:
    • the full name and address of the contributor
    • the date received
    • the monetary or non-monetary contribution amount
    • in the last row used, the total amount per contributor
    For example, in the case of the same contributor who made three separate contributions - two $75 monetary contributions and one $75 non-monetary contribution, for a total of $225 - for each contribution report the name and address of the contributor, the amount and the date received in one row. In the Total per contributor column of the third row, enter $225.
  3. For single contributions greater than $200, enter:
    • the full name and address of the contributor
    • the date received
    • the monetary or non-monetary contribution amount
    • the total amount per contributor
  4. Use as many pages as necessary, carrying forward the totals from the previous pages.
  5. For all aggregated contributions of $200 or less, other than contributions described in point 6 below, on the last page that you use for part 2a enter the total amount and number of contributions for both monetary and non-monetary contributions, and total the amounts and number of contributions in column 3. Be sure to count multiple contributions from the same contributor as one contributor.
  6. For anonymous contributions of $20 or less, on the last page that you use for part 2a enter in columns 1 and 2 the total amount and the approximate number of contributors for both monetary and non-monetary contributions, and enter in column 3 the total amounts and number of contributors. Be sure to include the supporting documentation for all anonymous contributions collected as a result of a general solicitation at a meeting or fundraising event: a description of the function at which the contributions were collected, the date of the function, the approximate number of people at the function, and the total amount of anonymous contributions accepted.
  7. On the last page of part 2a, enter the total amount of all contributions and the total number of contributors in the last two rows.

Part 2b. Statement of directed contributions received for transfer to a leadership contestant

In this part, list all directed contributions received by the party for a leadership contestant.

  1. Enter the name of the contributor.
  2. the name of the leadership contestant to whom the contribution was directed.
  3. Enter the full address of the contributor.
  4. Enter the date on which the party received the directed contribution.
  5. Enter the total amount received by the party.
  6. Enter the directed amount out of the total amount received.
  7. Enter the amount that was transferred to the leadership contestant.
  8. Carry forward the total of directed contributions from the previous to the last page of part 2b that you use and calculate the total.

Part 2c. Statement of contributions received - Details of operating loans

In this part of the return, you provide information on any loans taken by the party.

You should be aware that if an interest rate less than the market rate at the time you received the loan is charged on the loan, a non-monetary contribution equal to the value of the foregone interest was made to the campaign. If the value of the contribution is less than or equal to $200 and the lender is not normally in the business of lending, you do not need to report a contribution. But if the value of the contribution is greater than $200 or if the lender is in the business of lending funds, you must report a non-monetary contribution in part 2a.

  1. Enter the date you received the loan, the full name of the lender, and the full name of the guarantor, if applicable.
  2. Enter the complete address of the lender.
  3. Enter the interest rate.
  4. Enter the principal of the loan in column 1 for loans from individuals and column 2 for loans from others.
  5. Record the total amount and number of lenders for each category (individuals and others).
  6. In the overdraft/line of credit row, indicate whether or not an overdraft or line of credit was used by checking the Y or N box. If yes, record the name and address of the financial institution, the interest rate and the maximum amount drawn on the overdraft or line of credit.
  7. Attach a repayment schedule and a statement of conditions for all loans.

Part 2d. Statement of contributions received - Contributions returned to donors or otherwise dealt with in accordance with the Act

In this part, you must provide details of any contribution that you accepted and subsequently returned to the donor or remitted to the Chief Electoral Officer.

Do not report contributions you returned to the donor or remitted to the Chief Electoral Officer in any other part of the return.

  1. Enter the date you received the returned or remitted contribution.
  2. If available, enter the full name and address of the contributor, and check the box corresponding to the class of contributor (A for individuals and B for other).
  3. Enter the amount of the monetary contribution or the commercial value of the non-monetary contribution, and enter the date you returned the contribution to the donor or remitted it to the Chief Electoral Officer.
  4. If you use more than one page, carry forward the total of the Monetary and Non-monetary columns to the last page of part 2d, and enter the total monetary and non-monetary contributions you returned or remitted in the Total row.

Part 2e. Statement of transfers received

In this part of the return, you provide the details of all funds and goods and services transferred from a registered association or a candidate, and all funds transferred from a leadership contestant or a nomination contestant.

  1. Enter the name of the registered association, candidate, leadership contestant or nomination contestant that made the transfer.
  2. Enter the monetary or non-monetary amount of the transfer, as required, in the appropriate column 1 to 8. Column 6 (non-monetary transfers from leadership contestants) and column 8 (non-monetary transfers from nomination contestants) should not contain any amounts, because non-monetary transfers from leadership contestants and nomination contestants to registered parties are prohibited.
  3. Repeat this process for all transfers you received.
  4. Enter the total of each column in the Total row.

Part 2f. Summary of contributions, loans and transfers

In this part, you summarize the contributions, loans and transfers reported in parts 2a, 2c and 2e.

  1. In row 1, enter the monetary and non-monetary contributions and number of contributors you reported in the last two rows of part 2a.
  2. In row 2, enter the total amount and the number of loans reported from individuals in part 2c.
  3. In row 3, enter the total amount and the number of loans reported from others in part 2c.
  4. In row 4, enter the sum of rows 2 and 3.
  5. In row 5, enter the monetary and non-monetary transfers received from registered associations that you reported in the last row of part 2e.
  6. In row 6, enter the monetary and non-monetary transfers received from candidates that you reported in the last row of part 2e.
  7. In row 7, enter the monetary transfers received from leadership contestants that you reported in the last row of part 2e (non-monetary transfers from leadership contestants are prohibited).
  8. In row 8, enter the monetary transfers received from nomination contestants that you reported in the last row of part 2e (non-monetary transfers from nomination contestants are prohibited).
  9. In row 9, enter the sum of rows 5 to 8 for columns 1 to 3.
  10. In row 10, enter the sum of rows 1, 4 and 9 for columns 1 to 3.

Part 3a. Statement of election expenses for a by-election

An election expense is any cost incurred, or non-monetary contribution received, by a registered party to the extent that the property or service for which the cost was incurred, or the non-monetary contribution received, is used directly to promote or oppose a registered party, its leader or a candidate during an election period.

Goods and services may be paid for, donated or remain unpaid at the time of the report, or any combination of these. You should enter the amount of the payment, the commercial value of the goods or services donated or the amount remaining unpaid in the appropriate column, as applicable.

  1. Date: Enter the date on which the expense is incurred.
  2. Electoral district: Enter the name of the electoral district for which the party incurred the expense.
  3. Amount paid: Enter the amount paid to suppliers.
  4. Discount: Enter the difference between the amount charged to the party and the commercial value of the goods or services. If the goods or services were provided free of charge, enter the full commercial value in this column. Each amount must also appear in part 2a as a non-monetary contribution, or in part 2e as a non-monetary transfer from a registered association or a candidate. Commercial value, in relation to property or service, means the lowest amount charged at the time that it was provided for the same kind and quantity of property or service, or for the same use of property or money by:
    • the person who provided it, if the person is in the business of providing that property or service, or
    • another person who provides that property or service commercially in the area where it was provided, if the person who provided the property or service is not in that business
  5. Unpaid amount: Enter the amounts that remain unpaid. You may also have to report this information in part 3c.
  6. Commercial value of goods and services (columns 1 to 7): Enter the current commercial value of the goods or services under the appropriate column or columns. The price you enter should be equal to the sum of the Amount paid, the Discount and theUnpaid amount columns for that line.
  7. Repeat this process for all electoral districts for which the party incurred expenses.
  8. Total columns 1 to 7 individually. The total of the expenses you entered in columns 1 to 7 of Commercial value of goods and services must equal the sum of the Amount paid, Discount and Unpaid amount columns.
  9. If you use more than one page, carry forward the subtotals. On the last page of part 3a that you use, add together columns 1 to 7 as the Grand total. This amount is the total election expenses subject to the limit.

Part 3b. Statement of transfers to a candidate, an electoral district association, a leadership contestant or a nomination contestant

In this part, you disclose details of transfers from the party to a candidate, an electoral district association, a leadership contestant or a nomination contestant. For leadership or nomination contestants, only transfers of goods or services offered equally to all contestants of a particular contest are allowed (with the exception of directed contributions for leadership contestants, which you must report in part 2b). You must not enter any amounts in the shaded areas of this part, because monetary transfers to leadership contestants and nomination contestants are prohibited.

  1. Enter the electoral district.
  2. Enter the name of the electoral district association, the name of the candidate, leadership contestant or nomination contestant who received the transfer.
  3. In the appropriate column, enter the amount transferred, classified as monetary or non-monetary, as required.
  4. Total each column individually.

Part 3c. Statement of unpaid claims

In this part, list all the registered party’s unpaid claims for which an invoice was sent more than three months after the expense was incurred, or for which the invoice remained unpaid six months after it was due. You must also list all disputed claims. You must not pay these claims, either disputed or undisputed, without the authorization of the Chief Electoral Officer.

If the Chief Electoral Officer refuses the authorization or the party cannot meet the conditions of the authorization, a registered agent of the party, including the chief agent, or the claimant may make an application to a judge to authorize the payment of the claim.

  1. Full name of supplier: Enter the name of the supplier. If the supplier is an individual, enter the family name, given name and initial, if applicable. If the supplier is a corporation or a business, write the name of the supplier across the space. In the case of a numbered company, provide the name of the chief executive officer or the president.
  2. Address: Enter the address of the supplier.
  3. Class of contributor: Indicate the class of contributor to which the claimant belongs.
  4. Amount agreed and Amount disputed: Enter the amount of the unpaid claim that is agreed in the Amount agreed column, or enter the amount that is disputed in the Amount disputed column. If part of the claim is disputed and part undisputed, enter the appropriate amount in each column.

If you use more than one page, carry forward the totals of agreed and disputed unpaid claims to the last page of part 3c that you use and calculate the total.

Part 4. Party financial statements

This part lists the documents that you must attach to the Registered Party Financial Transactions Return (EC 20239):

  • a statement of the registered party’s assets and liabilities and any surplus or deficit in accordance with generally accepted accounting principles, under paragraph 424(2)(f) of the Act
  • a statement of the registered party’s revenues and expenses in accordance with generally accepted accounting principles, under paragraph 424(2)(g) of the Act
  • the auditor’s report on the return

Introduction

As the chief agent of a registered political party that is entitled to a quarterly allowance, you must submit the Registered Party Financial Transactions Quarterly Return (EC 20211) to the Chief Electoral Officer within 30 days of the end of the fiscal quarter. You must submit this information only for the quarter to which it pertains, ince the return is not cumulative. This introduction to the form gives a brief description of the contents of the two parts of the form, and is followed by detailed instructions for filling out the return.

Lists all contributions received from individuals, including the date received, the name, address and amount of all aggregated monetary and non-monetary contributions for contributors who have given over $200 in the quarter, the amount and number of all monetary and non-monetary contributions of $200 or less, and the amount and approximate number of anonymous monetary and non-monetary contributions of $20 or less collected as a result of a general solicitation at a meeting or fundraiser.

Part 2b. Statement of directed contributions received for transfer to a leadership contestant

Lists directed contributions received by the registered party for a leadership contestant and then transferred to the leadership contestant, including the date the contribution is received by the party, the full names and address of the contributor, the total amount of the contribution, the directed amount, the amount transferred to the leadership contestant and the date of the transfer.

By class of contributor, lists the date received, the name and address of the contributor, if known, the amount or commercial value of any contribution that was returned to the donor or remitted to the Chief Electoral Officer, and the date that the contribution was returned or remitted.

Part 2d. Statement of transfers received

Lists the date received, the name of the transferor, and the monetary or non-monetary amount, as required, transferred from the registered association, a candidate, a leadership contestant or a nomination contestant.

Part 2e. Summary of contributions and transfers

Part 1. Declaration

Part 2b. Statement of directed contributions received for transfer to a leadership contestant

In this part, list all directed contributions received by the party from individuals for a leadership contestant.

  1. Enter the name of the contributor.
  2. Enter the name of the leadership candidate to whom the contribution was directed.
  3. Enter the full address of the contributor.
  4. Enter the date on which the party received the directed contribution.
  5. Enter the total amount received by the party.
  6. Enter the directed amount out of the total amount received.
  7. Enter the amount that was transferred to the leadership contestant.
  8. Carry forward the total of directed contributions from the previous to the last page of part 2b that you use and calculate the total.

Part 2c. Statement of contributions received - Contributions returned to donors or otherwise dealt with in accordance with the Act

In this part, you must provide details of any contribution that you accepted and subsequently returned to the donor or remitted to the Chief Electoral Officer.

Do not report contributions you returned to the donor or remitted to the Chief Electoral Officer in any other part of the return.

  1. Enter the date you received the returned or remitted contribution.
  2. If known, enter the full name and address of the contributor, and check the box corresponding to the class of contributor (A for individuals or B for others).
  3. Enter the amount of the monetary contribution or the commercial value of the non-monetary contribution, and enter the date you returned the contribution to the donor or remitted it to the Chief Electoral Officer.
  4. If you use more than one page, carry forward the total of the Monetary and Non-monetary columns to the last page of part 2c, and enter the grand totals of monetary and non-monetary contributions you returned or remitted in the Total row.

Part 2d. Statement of transfers received

In this part of the return, you provide the details of all funds and goods and services, as required, transferred from a registered association, a candidate, a leadership contestant or a nomination contestant.

  1. Enter the date the transfer was received.
  2. Enter the name of the registered association, candidate, leadership contestant or nomination contestant that made the transfer.
  3. Enter the monetary or non-monetary amount of the transfer in the appropriate column 1 to 8. Column 6 (Leadership contestant - Non-monetary) and column 8 (Nomination contestant - Non-monetary) should not contain any amounts, because non-monetary transfers from leadership contestants and nomination contestants to registered parties are prohibited.
  4. Repeat this process for all transfers you received.
  5. Enter the total of each column in the Total row.

Part 2e. Summary of contributions and transfers

In this part, you summarize the contributions and transfers reported in parts 2a, 2b and 2d.

  1. In row 1, enter the monetary and non-monetary contributions and number of contributors you reported in the last two rows of part 2a.
  2. In row 2, enter the monetary and non-monetary transfers received from registered associations that you reported in the last row of part 2d.
  3. In row 3, enter the monetary and non-monetary transfers received from candidates that you reported in the last row of part 2d.

Part 1. Declaration

A. Party’s Information

Enter the full name, address, telephone number and e-mail address of the registered party.

B. Chief Agent’s Information

As the party’s chief agent, enter your full name, address, telephone number and e-mail address.

C. Declaration

Read, sign and date the declaration about the completeness and accuracy of the information you are reporting.

Part 2. Statement of general election expenses

In this part of the return, you record the election expenses incurred against the limit.

  1. For item 1, radio and television advertising, enter the Amount paid, Discount and Unpaid claim election expenses incurred, and total the amounts in the far right column.

    Amount paid: Enter the amount paid to suppliers (including those for whom you have prepared cheques).

    Discount: Enter the difference between the amount charged to the campaign and the commercial value of the goods or services. If the goods or services were provided free of charge, enter the full commercial value in this column. If the commercial value is $200 or less, do not enter the value of goods or services donated by persons not in the business of supplying these goods or services.

    Unpaid claim: Enter the amount of claims that remain unpaid.

  2. Repeat step 1 for items 2 through 9 (the remaining eight election expenses categories).
  3. Total election expenses subject to the limit: Add up the Total results of items 1 through 9 and record the grand total.
  4. Election expenses limit: Enter the permitted limit of election expenses that Elections Canada provided to you earlier.

Part 3. Statement of unpaid claims

In this part, list all the registered party’s unpaid claims for which an invoice was sent more than three months after the expense was incurred, or for which the invoice remained unpaid six months after it was due. You must also list all disputed claims. You must not pay these claims, either disputed or undisputed, without the authorization of the Chief Electoral Officer.

If the Chief Electoral Officer refuses the authorization or the party cannot meet the conditions of the authorization, a registered agent of the party, including the chief agent, or the claimant may make an application to a judge to authorize the payment of the claim.

  1. Full name of supplier: Enter the name of the supplier. If the supplier is an individual, enter the family name, given name and initial, if applicable. If the supplier is a corporation or a business, write the name of the supplier across the space. In the case of a numbered company, provide the name of the chief executive officer or the president.
  2. Address: Enter the address of the supplier.
  3. Class of contributor: Indicate the class of contributor to which the claimant belongs.
  4. Amount agreed and Amount disputed: Enter the amount of the unpaid claim that is agreed in the Amount agreed column, or enter the amount that is disputed in the Amount disputed column. If part of the claim is disputed and part undisputed, enter the appropriate amount in each column.

If you use more than one page, carry forward the totals of agreed and disputed unpaid claims to the last page of part 3 that you use and calculate the total.
