4.   Complaints and Judicial Review

Individuals who are not satisfied with the processing of their access to information request can file a complaint with the Office of the Information Commissioner of Canada (OIC).

The OIC received a total of five complaints against Elections Canada in 2014–2015. Four of the cases are related to whether Elections Canada had applied all exemptions correctly or provided all records responsive to the requests.

The fifth case relates to an outstanding complaint from 2011–2012 in which the OIC has not yet issued a finding. At issue is whether Elections Canada should provide its political contributions and expenses database in an alternative format to the version published online. Originally, this request was excluded under the provisions set out in paragraph 68(a) of the Act.

All complaints received within the 2014–2015 fiscal year are currently open and ongoing.

No judicial reviews were reported to Elections Canada in 2014–2015.
